Athlete Terms of Use

Athlete Terms of Use

Version 1.0 · in effect from 11 Oct 2026

These Terms are the contract between SPLT Club and every athlete or guardian using the Platform.

1. About these Terms

1.1 These Terms of Use ("Terms") form a legally binding agreement between you and SPLT Club [Ltd], a company registered in England and Wales under company number [Company Number], whose registered office is at [Registered Address] ("SPLT Club", "we", "us", "our").

1.2 These Terms govern your access to and use of the SPLT Club websites, mobile applications and related services (the "Platform").

1.3 By ticking the acceptance box, you confirm that you have read, understood and agree to these Terms. If you do not agree, you must not use the Platform.

1.4 These Terms should be read with your Club's privacy notice, our Privacy Notice and our Consumer Health Data Privacy Policy, which explain how personal data is handled.

2. Definitions

"Athlete" means the individual whose account it is. "Athlete Content" means data, text, images and other material submitted by or about you through the Platform, including training, performance and health data. "Club" means a sports club, team, academy or organisation that uses the Platform and has invited you, or that you have joined. "Club Staff" means coaches, medical, performance and administrative staff authorised by your Club. "Guardian" means a parent or other person with legal parental responsibility for an Athlete under 18. "Minor" means a person under 18. "Athlete Profile" means your account and the Athlete Content that you, your Guardian, your Club Staff or your connected devices add to it, including your history on the Platform. "Club Records" means information a Club or its Club Staff create about you, such as coaching notes, attendance and selection records.

3. Eligibility and Minors

3.1 You can create an account when a Club invites you. Your account and Athlete Profile remain yours if you later leave that Club or join another.

3.2 If you are 18 or over, you may accept these Terms yourself.

3.3 If you are 16 or 17, you may accept these Terms yourself. Where your Club has provided Guardian details, we may also invite your Guardian to accept them, but your access does not depend on it.

3.4 If you are under 16, your Guardian must accept these Terms on your behalf and give the consents required before your account can be used. Until you turn 16 your Guardian can see and change your consents, your sharing choices and your account settings, and can see your training. Your Guardian cannot see your health and wellbeing information.

3.5 A Guardian who accepts these Terms confirms that they hold parental responsibility for the Athlete, and accepts responsibility for the Athlete's use of the Platform while they are under 16.

3.6 We or your Club may request reasonable evidence of age or Guardian status, and may suspend an account until it is provided.

4. Your relationship with your Club

4.1 We are the data controller of your Athlete Profile. A Club can see your Athlete Profile only if you (or your Guardian) give it permission, and only as described in this clause 4.

4.2 Your Club is solely responsible for its coaching, selection, safeguarding and medical decisions. We are not a party to your membership arrangements with your Club.

4.3 Each Club is the data controller of its Club Records and decides what it records about you. We process Club Records on the Club's behalf. Club Records stay with the Club that created them and never move to another Club.

4.4 When you join a Club, you choose whether to share your Athlete Profile with it, and whether to include your history from before you joined. You can stop sharing with a Club at any time in Settings, and that Club's access ends immediately.

4.5 When you leave a Club, or its subscription ends, that Club keeps read-only access for 60 days to the information you shared while you were a member, so it can complete its records. It cannot see anything you add after you leave. After 60 days its access ends.

5. Your account

5.1 You must provide accurate, current and complete information and keep it up to date.

5.2 You are responsible for keeping your login credentials confidential and for all activity under your account. You should enable multi-factor authentication where it is offered.

5.3 You must tell us immediately at [Security Email] if you suspect unauthorised access to your account.

5.4 Accounts are personal. You must not share your account or allow anyone else to use it.

6. Licence to use the Platform

Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Platform for your own training and participation in your Club's activities. All rights not expressly granted are reserved.

7. Acceptable use

You must not, and must not attempt to:

  • (a) access another person's account or data without authorisation;
  • (b) upload content that is unlawful, defamatory, harassing, discriminatory or obscene, or that infringes anyone's rights;
  • (c) upload personal data about another person without a lawful right to do so;
  • (d) introduce viruses or other harmful code, or interfere with the Platform's security, integrity or performance;
  • (e) copy, modify, scrape, data-mine, reverse engineer, decompile or create derivative works of the Platform, except as permitted by law;
  • (f) access the Platform by automated means other than through interfaces we provide;
  • (g) use the Platform for any commercial purpose other than your Club's activities; or
  • (h) use the Platform in breach of any applicable law, or the rules of any sports governing body or anti-doping organisation.

8. Athlete Content

8.1 As between you and us, you own the Athlete Content you provide. Club Records belong to the Club that created them.

8.2 You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit and display Athlete Content solely to provide, secure, support and maintain the Platform, and to make your Athlete Profile available to the Clubs you choose.

8.3 We may create aggregated and de-identified information that cannot reasonably be used to identify you or your Club, and use it to operate, analyse and improve our services.

8.4 You confirm that you have the right to submit any Athlete Content you provide, and that it is accurate to the best of your knowledge.

8.5 We do not routinely monitor Athlete Content, but we may remove or restrict content that we reasonably believe breaches these Terms or applicable law.

9. Health, safety and assumption of risk

9.1 The Platform is a training, performance and athlete-management tool. It is not a medical device, and it is not intended to diagnose, treat, cure, mitigate or prevent any disease, injury or medical condition.

9.2 Information on the Platform, including metrics, readiness or load indicators, training plans and Club Staff notes, is general information only. It is not a substitute for advice from a qualified medical professional.

9.3 You should consult a qualified professional before starting or changing a training programme, and seek prompt medical attention if you experience pain, illness or injury. Never delay seeking care because of anything on the Platform.

9.4 Sport and physical training carry inherent risks of injury. Subject to clause 15.1, you participate in training at your own risk.

9.5 The Platform is not an emergency service and is not monitored in real time. In an emergency, call your local emergency number.

10. Third-party services and devices

10.1 The Platform may allow you to connect third-party devices or services, such as wearables. Connecting them is optional.

10.2 Third-party services are governed by their own terms and privacy policies. We are not responsible for their availability, accuracy, security or practices.

10.3 You may disconnect a third-party service at any time in Settings.

11. Intellectual property and feedback

11.1 The Platform, including its software, design, text, graphics, logos and trade marks, is owned by or licensed to us and is protected by intellectual property laws.

11.2 If you give us suggestions or feedback, we may use them freely without restriction or payment to you.

12. Privacy

12.1 Our Privacy Notice and Consumer Health Data Privacy Policy explain how we handle your Athlete Profile. Each Club's privacy notice explains how that Club uses the information you share with it, and its Club Records.

12.2 You can exercise your data protection rights over your Athlete Profile in Settings, or by contacting us at [Privacy Email]. For Club Records, contact the Club. If you contact us instead, we will pass your request to that Club and help it respond.

13. Suspension and termination

13.1 You may stop using the Platform and delete your account at any time in Settings. Leaving a Club does not close your account.

13.2 We may suspend or terminate your account if you materially breach these Terms, if required by law, or to protect the security of the Platform or other users. A Club may also remove you from its membership. This ends its access as described in clause 4.5, but does not close your account.

13.3 Where reasonable, we will give you notice and an opportunity to remedy a breach before suspending access, unless urgent action is needed.

13.4 The Platform cannot be used without your consent for us to hold your health and wellbeing information, because that information is central to what the Platform does. If you withdraw that consent, your account is suspended, you can download a copy of your data, and your health information is deleted within 30 days.

13.5 If you delete your account, we delete your Athlete Profile within 30 days and Clubs lose access immediately. Each Club handles its Club Records about you under its own privacy notice. If your account has no Club membership and no sign-ins for [2] years, we will warn you, and then delete it if you do not respond within [30] days. You can download a copy of your data at any time.

13.6 Clauses 8.3, 11, 15, 16, 17 and 19 survive termination, together with any other provision that by its nature is intended to survive.

14. Changes to the Platform and these Terms

14.1 We may update, improve, add or remove features of the Platform. We will give reasonable notice of changes that materially reduce its functionality.

14.2 We may amend these Terms to reflect changes in law, our services or our business. We will notify you of material changes at least [30] days in advance and ask you to accept them where required. If you do not accept them, you may stop using the Platform.

15. Our liability to you

15.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

15.2 If you are a consumer, these Terms do not affect your statutory rights. If you live in the UK or EU, we are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.

15.3 To the extent permitted by law, the Platform is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, or that data or metrics will be accurate or complete.

15.4 To the extent permitted by law, we are not liable for: (a) losses not caused by our breach; (b) indirect or consequential losses, or losses that were not reasonably foreseeable; (c) decisions made by you, your Club or Club Staff using information on the Platform; or (d) loss of data that you or your Club could reasonably have prevented.

15.5 The Platform is provided to you free of charge. Payments you make to your Club through the Platform, such as fees, are between you and your Club. To the extent permitted by law, our total aggregate liability to you arising out of or in connection with these Terms is limited to £100 (or the equivalent in your local currency).

16. Your responsibility for misuse

If you use the Platform other than as a consumer, or deliberately breach clause 7, you will compensate us for reasonable losses, costs and expenses arising from that breach, to the extent permitted by law.

17. Governing law and disputes

17.1 These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales.

17.2 If you are a consumer living in Scotland or Northern Ireland, you may bring proceedings in your local courts. If you are a consumer living in the EU, you also benefit from the mandatory provisions of the law of your country, and you may bring proceedings in your local courts.

17.3 Before starting proceedings, please contact us at [Contact Email] so that we can try to resolve the matter informally. We will respond within [30] days.

18. Additional terms for North America

18.1 United States. [For US counsel: decide whether to include binding individual arbitration with a class action waiver and a 30-day opt-out. It must not apply to UK or EU users.] Nothing in these Terms limits any rights you have under applicable state law.

18.2 Canada. Nothing in these Terms excludes rights you have under the consumer protection laws of your province or territory. If you live in Quebec, these Terms are provided in French, and [the French version prevails].

19. General

19.1 Entire agreement. These Terms, together with the documents referred to in them, are the entire agreement between you and us about the Platform.

19.2 Transfer. We may transfer our rights and obligations under these Terms to another organisation, and will tell you if we do. You may not transfer yours.

19.3 Severability. If any provision is found to be unenforceable, the remaining provisions stay in full force.

19.4 No waiver. A delay in enforcing any provision does not waive our right to enforce it later.

19.5 Third parties. Your Club may enforce clauses 4, 7 and 13. Otherwise, no one other than you and us has any right to enforce these Terms.

19.6 Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control. We will tell you and take reasonable steps to minimise the effect.

19.7 Language. Where we provide translations, the English version prevails unless local law requires otherwise.
